By using the CalMePlease application (hereinafter referred to as the "Service"), you agree to and accept the terms and conditions of this public offer (hereinafter referred to as the "Offer") and the privacy policy. Please read this document carefully, and if you disagree with any part of it, you should refrain from using the Service.

About the Application

CalMePlease is a calorie tracking app available online at https://calmeplease.io, as well as on the App Store and Google Play. It allows you to monitor your health by tracking calories. Record your meals to understand calorie intake and nutritional value. Track your activity – monitor daily exercises and movements to see how they affect your health goals. The app includes an AI-powered assistant that recognizes text, voice, or images of food or dishes provided by the user, including their calorie content and nutritional composition.

Using the Service

By using the Service, you agree that:

  • The Service is available for personal use only and is not intended for commercial use.
  • You are fully responsible for all actions under your account and all content uploaded and/or created under your account in the Service.
  • The Service reserves the right to delete your user account along with all your data and terminate your membership at any time at its discretion.
  • You are responsible for securely storing your login data for the Service. The Service is not responsible for any loss or damage caused by unauthorized access to your account or the use of your login credentials.
  • If you become aware of or suspect any unauthorized use of your account, you must immediately notify us using the contact information provided in this document.
  • The Service is not intended for use by individuals under the age of 18. You must be at least 18 years old to use the Service.
  • Violating any of these Terms will result in the immediate termination of your user account and subscription.
  • The services provided by the Service are for entertainment and educational purposes only. The Service is not a medical organization and does not provide medical advice or diagnostic services. The Service is not responsible for any bodily injury or other damage that may result, directly or indirectly, from any use or misuse of the Service.
  • You may only use the Service in accordance with the law and these Terms.

Conditional Nature of Calculations

All calorie calculations provided by our app are based on user input (photos, voice, and text descriptions). The accuracy of these calculations may vary depending on the quality and accuracy of the data entered.

The AI-based calorie estimation technology cannot guarantee 100% accuracy, as it depends on many factors, such as the variety of dishes, cooking methods, and the accuracy of the entered data. The user acknowledges and accepts that the calorie calculations are conditional and uses the Service at their own risk.

Non-Mandatory Nature of Recommendations

All nutrition recommendations provided by our app are based on AI calculations and are for entertainment and educational purposes only.

The user should understand that the AI system does not provide dietetics services or advice. For precise and personalized nutrition recommendations, users should consult qualified professionals.

The app is not intended for medical diagnosis or treatment and cannot replace consultation with a medical professional.

Your Account

You may cancel your membership and/or delete your account with all your personal data at any time. Note that deleting the mobile app or deleting your account will not automatically stop your subscription – you must cancel your subscription yourself through your Apple App Store account. Health and Nutrition Information

You are responsible for your health. The Service is not a medical organization and will not provide you with medical consultations or diagnostic services. Information provided through the Service is for entertainment and educational purposes only. Always consult a doctor before starting a diet or fitness program, or if you experience pain or discomfort. The Service cannot guarantee any results or improvements related to health, weight, and/or fitness. The Service is intended for healthy adults only. Please do not use the Service if you suffer or may suffer from any disease that could be aggravated by diet or physical activity.

The nutritional information in our database has not been verified, researched, or reviewed by us. The Service cannot guarantee that the nutritional information presented in its database is accurate, reliable, or complete. The Service is not responsible for any bodily injury or other damage that may result, directly or indirectly, from any use or misuse of the information provided.

The Service is not responsible for any losses related to the accuracy or completeness of the provided information, interruptions in the app’s functionality or unavailability, lost data, or any other losses related to the use of the app.

The user assumes full responsibility for any actions taken based on the information provided by the app. We strongly recommend that users always consult professionals in relevant fields before making any decisions based on the data provided by our app.

The Service is provided "as is" and "as available" without any warranties, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Subscription and Paid Services

After the 7-day trial period, the Service will offer you the option to purchase a paid subscription. The payment is necessary to cover the costs associated with supporting the GPT model that recognizes voice, text, or photos, as well as infrastructure costs and further development of the service. By paying for the subscription, you gain full access to all the functional features of the Service for the duration of your subscription in accordance with this Offer.

All subscriptions to the Service are paid in advance. You may cancel your membership at any time, and in that case, your membership will remain valid for the duration of the subscription period that you have already paid for. You can cancel your subscription only through your Apple App Store or Google Play Store account.

The Service reserves the right to change the subscription fee from time to time. All payments are processed by the Apple or Google platforms and may only be refunded with their consent. Limitation of Liability

The Service is provided "as is," without any warranties, including uninterrupted and error-free service. We are not liable for any errors or omissions in the information or software or other documents referred to or incorporated by reference in the Service's databases.

The Service is not responsible for any direct, indirect, incidental, special, punitive, or consequential damages that may result from the use of our app, even if we have been advised of the possibility of such damages, including medical conditions that could result directly or indirectly from the use or misuse of the Service.
